1. Acceptance of Terms & Eligibility

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and CHERRY SOFTWARES LLC ("Company", "we", "us", or "our"), governing your access to and use of the IlmFun platform, website at ilmfun.com, Windows desktop application, mobile apps (Android and iOS), and all related services, real-time communications hubs, and APIs.

Eligibility:

You must be at least 13 years of age (or the legal age of digital majority in your jurisdiction) to register an account. If you are under the age of majority in your jurisdiction, you may only use IlmFun with the verified consent and supervision of a parent, legal guardian, or authorized educational institution.

2. Account Registration & Security

• Accurate Information: When registering, you agree to provide true, accurate, and current information. You may not impersonate any person or entity or misrepresent your affiliation with any educational institution.
• Credential Protection: You are solely responsible for maintaining the confidentiality of your login credentials (username, password, or OAuth tokens) and for all activities that take place under your account.
• Account Security: You must immediately notify CHERRY SOFTWARES LLC at support@ilmfun.com if you suspect any unauthorized access or breach of your account security.
• Non-Transferability: Accounts are personal to the registered user. You may not sell, lease, transfer, or assign your account or credentials to any other party.

3. Academies & Community Standards

IlmFun is structured around "Academies" — collaborative, structured digital learning spaces designed for classrooms, study groups, educational communities, and subject-matter exploration.

All members, learners, and educators agree to maintain a safe, respectful, and productive educational atmosphere. Academies must never be used for unlawful, exploitative, predatory, or disruptive purposes.

4. Academy Administration, Roles & Moderation

Each Academy possesses a role-based permission hierarchy, including Academy Owners, Administrators, Moderators, Educators, and Students:

• Owner & Admin Authority: Academy Owners and Administrators hold local moderation authority within their respective academy, including configuring channels, assigning roles, establishing room policies, and kicking or banning disruptive participants.
• Platform Moderation: CHERRY SOFTWARES LLC retains the overarching right, but not the obligation, to investigate complaints and suspend or remove any academy, channel, or user account that violates platform guidelines, facilitates copyright infringement, or conducts fraudulent operations.

5. Educators & Verified Instructor Badges

Educators on IlmFun may apply for official verification badges by submitting educational credentials, accreditations, or proof of identity:

• Independent Educators: Instructors and educators are independent third parties and are not employees, agents, or partners of CHERRY SOFTWARES LLC.
• Educational Standards: Verified educators are responsible for the accuracy, legality, pedagogical quality, and integrity of their curricula, lesson materials, and descriptions.

6. Live Lessons, Classes & WebRTC Communications

Live interactive classes and audio/video stages are delivered using low-latency WebRTC technology.

• Classroom Conduct: Attendees must observe respectful decorum during live classes. Disrupting lectures, unmuting inappropriate audio, or broadcasting offensive camera feeds will result in immediate removal and potential platform-wide banning.
• Recording Restrictions: Users are strictly prohibited from capturing, screen-recording, or redistributing live audio or video streams of instructors or fellow students without explicit written permission from all session participants and the host academy.

7. Virtual Economy ("Emeralds") & Transactions

IlmFun includes an in-app virtual currency system designated as "Emeralds".

• Purchases: Emeralds may be purchased through authorized app store billing systems (Google Play or Apple App Store). All purchases are final and non-refundable, except as required by mandatory consumer protection legislation.
• Usage: Emeralds may be used to enroll in scheduled paid lessons, attend specialized workshops, tip creators, or unlock custom academy perks.
• Educator Payouts: Verified instructors who accumulate Emeralds through completed educational classes may be eligible to request payouts in accordance with our separate Creator Monetization Agreement, subject to identity verification, anti-fraud screening, and compliance with applicable tax laws.

8. Intellectual Property & User Content

A. User Content Ownership

You retain full copyright and ownership of any educational presentations, homework, original articles, slides, and learning materials that you submit or upload to IlmFun ("User Content").

By uploading User Content to IlmFun, you grant CHERRY SOFTWARES LLC a limited, non-exclusive, worldwide, royalty-free license solely to host, store, transcode, cache, and transmit such content as necessary to provide the services to you and your authorized academy members.

B. Platform Intellectual Property

All software, user interfaces, logos, brand names, visual styling, source code, and design tokens associated with IlmFun are the exclusive intellectual property of CHERRY SOFTWARES LLC. You may not decompile, reverse-engineer, copy, redistribute, or exploit any part of the platform without our prior written consent.

9. Prohibited Conduct & Platform Integrity

You agree not to engage in any of the following prohibited activities:

• Harmful or Abusive Behavior: Harassment, bullying, stalking, hate speech, defamation, threats of violence, or publishing private personally identifiable information ("doxxing").
• Academic Dishonesty & Fraud: Operating academic cheating rings, distributing stolen exam materials, or selling counterfeit academic degrees.
• Technical Abuse: Distributing viruses, trojans, worms, or malicious code; launching denial-of-service (DDoS) attacks against our WebSocket servers or LiveKit media routers; automated scraping or spidering without authorization.
• Intellectual Property Infringement: Uploading copyrighted textbooks, pirated software, or proprietary educational courses without the copyright owner's license.

10. Account Termination & Suspension

By You: You may delete your account at any time via App Settings → Account → Delete Account.

By CHERRY SOFTWARES LLC: We reserve the right to temporarily suspend or permanently terminate your account, remove your academy, or disable access if you violate these Terms, fail to comply with our community standards, engage in fraudulent transactions, or if required by law.

To the maximum extent permitted by applicable law, in no event shall CHERRY SOFTWARES LLC, its officers, directors, employees, or contractors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including loss of profits, data, or goodwill.

In all circumstances, CHERRY SOFTWARES LLC's total cumulative liability arising out of or related to these Terms or the use of IlmFun shall not exceed the total amount paid by you to CHERRY SOFTWARES LLC in the twelve (12) months preceding the incident, or fifty United States dollars ($50.00 USD), whichever is greater.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws applicable to CHERRY SOFTWARES LLC, without regard to conflict of law principles.

Informal Dispute Resolution: Prior to filing any formal legal claim, you agree to contact us at legal@ilmfun.com and attempt in good faith to resolve the dispute informally for a period of at least thirty (30) days.
